Terms & Conditions

Effective Date: 01/06/2025

These Terms and Conditions (“Terms”) apply to all pest management services (“Services”) provided by NatureWise Pest Control (“Company”, “we”, “our”, “us”) to any client (“Client”, “you”). By booking, confirming, or permitting our Services, you are deemed to have accepted these Terms.

 

Services & Fees

1.1. NatureWise Pest Control agrees to provide pest control services at the Client’s property in accordance with these Terms. Unless otherwise agreed in writing, termite inspections and termite treatments are excluded.

1.2. The Service will cover only the pest species and treatment areas described in the written Service Proposal or Report.

1.3. The total service fee (“Fee”) includes GST and is payable as per Section 2.

 

Payment & Late Fees

2.1. Fees must be paid on or before completion of the Service, unless otherwise agreed in writing.

2.2. Accepted payment methods include cash, EFT, or credit/debit card. Card payments are securely processed via Stripe. An additional processing fee may apply.

2.3. Where invoices are issued, payment is due within 14 days of the service date.

2.4. If payment is not received within 14 days, the Client agrees that:

  • Interest may accrue daily on overdue amounts.

  • A late payment fee of $7.50 per day will apply until full payment is received.

2.5. Late payment fees do not apply to Clients with an agreed payment plan, provided instalments are met.

2.6. Failure to pay may result in suspension of future services and referral to a debt recovery agency.

 

Health, Safety & Care Obligations

3.1. The Client must advise us of:

  • Any pets, aquariums, aviaries, or livestock on the property.

  • Any people with allergies, respiratory conditions, or other health concerns.

3.2. As a precaution, sensitive persons and pets should remain away from treated areas for at least 24 hours or until the premises are fully ventilated.

3.3. The Client must:

  • Remove or protect all people, pets, and animals before treatment.

  • Cover all food, utensils, and sensitive surfaces.

  • Avoid contact with treated areas until deemed safe by the technician.

  • Ventilate the premises after treatment.

3.4. The Client must provide safe access to all treatment areas and ensure utilities (water, electricity, etc.) are available.

3.5. Where drilling, dusting, or baiting is required, the Client is responsible for identifying and advising us of any utilities, wiring, or pipes that may be affected. We accept no liability for damage caused where information was not provided.

 

Service Effectiveness & Limitations

4.1. We deliver Services in a professional manner, but treatment effectiveness depends on:

  • The Client following hygiene, cleaning, and maintenance recommendations.

  • Avoiding disturbance of treated areas or equipment.

  • Not introducing untreated or infested items into the property.

4.2. Our inspections are visual only and limited to accessible areas at the time of inspection. Furniture, stored goods, or structural barriers may restrict visibility and reduce effectiveness.

4.3. Services do not include treatment of furniture or household contents unless specifically agreed in writing.

4.4. Certain pests (including termites, bed bugs, birds, or wildlife) require specialist treatment not covered by standard general pest services unless explicitly included.

 

Reports, Advice & Indemnity

5.1. At the conclusion of a Service, we will provide a Service Report outlining treatments carried out, pest activity observed, and recommendations.

5.2. Reports and advice are provided solely for the Client’s use and cannot be transferred, sold, or relied upon by third parties without written consent.

5.3. To the maximum extent permitted by law, the Client indemnifies us against claims, costs, or liabilities arising from third-party reliance on any report or advice.

 

Warranties, Liability & Limitations

6.1. Services are delivered in accordance with industry standards and product manufacturer guidelines. Unless otherwise stated in writing, no warranty is given that pests will be completely or permanently eradicated.

6.2. Where a service guarantee (e.g. 30-day guarantee) is expressly provided, it is strictly conditional upon the Client:

  • Following all recommendations outlined in the Service Report.

  • Maintaining hygiene and cleaning practices.

  • Removing clutter, rubbish, vegetation, or debris that may harbour pests.

  • Implementing proofing measures such as sealing cracks, repairing screens, fixing leaks, or blocking entry points.

  • Avoiding the introduction of infested goods, untreated furniture, or materials.

  • Allowing follow-up visits within the agreed timeframe.

  • Not disturbing, tampering with, or relocating treatment equipment, baits, or treated surfaces.

6.3. Guarantees are void if:

  • Recommendations are not implemented.

  • Neighbouring properties or external sources cause re-infestation.

  • Extreme weather, flooding, renovations, or landscaping interfere with treatments.

  • The Client uses unapproved chemicals or cleaners that disrupt treatments.

  • Infestation arises due to unaddressed structural defects or sanitation issues.

6.4. Liability is strictly limited, at our discretion, to:

  • The re-supply of services, or

  • The cost of re-supplying services.

6.5. To the maximum extent permitted by law, we are not liable for:

  • Loss of profit, revenue, or business.

  • Consequential or indirect loss or damage.

  • Pest recurrence due to Client negligence, hygiene issues, or refusal to implement proofing.

  • Illness or sensitivity where medical conditions were not disclosed before treatment.

  • Cosmetic or minor property damage resulting from required drilling, dusting, or baiting.

6.6. Nothing in these Terms excludes or limits rights guaranteed under the Competition and Consumer Act 2010 (Cth). Where our liability cannot be excluded, it is limited to the extent permitted by law.

 

Right to Refuse Service

We reserve the right to refuse or withdraw services if:
 

  • The property presents health or safety risks to our staff.

  • The Client fails to disclose relevant information (e.g. aggressive animals, unsafe access).

  • Conditions prevent safe or effective treatment (e.g. no access to areas needed, client refusal to exit treatment area).

 

Rescheduling & Cancellations

8.1. We may reschedule Services due to weather, illness, equipment failure, or regulatory restrictions.

8.2. Clients who cancel with less than 24 hours’ notice may incur a call-out fee.

 

Record Retention

NatureWise Pest Control is legally required to retain certain records, including pesticide usage logs, service reports, and risk assessments, for compliance with NSW WorkCover and NSW EPA. Such records cannot be deleted upon request.

 

Entire Agreement

These Terms constitute the entire agreement between the parties and replace all prior agreements or understandings. No variation is binding unless agreed in writing.

 

Governing Law

These Terms are governed by the laws of New South Wales. Both parties submit to the jurisdiction of the courts of that State.
